Terms of Use
Last updated: October 13, 2026
In short: our apps help you notice everyday habits. They are not medical advice or a medical device, every number they show is an estimate, results aren’t guaranteed, and you are responsible for the decisions you make and for the data on your device. Please read sections 4, 5, 14 and 15 carefully: they limit our responsibility.
1. Agreement
These Terms of Use (“Terms”) are an agreement between you and DayDay (“DayDay”, “we”, “us”). They apply to our website at dayday.app (the “Site”) and to our apps, including Forward and Rest, and any related features or updates (the “Apps”; together with the Site, the “Services”). By using the Services you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Services.
2. Who can use the Services
You must be at least 18 years old and able to form a binding contract to use the Services. The Services are not intended for, and should not be used by, anyone under 18.
3. The Services
DayDay makes apps for everyday health. Forward is designed to help you log meals and movement and follow a calorie deficit; Rest is designed to help you note and review your sleep. Both are in development. Features, designs and timelines described on the Site are plans and may change. We may add, change, suspend or discontinue any part of the Services at any time, with or without notice, and we are not liable to you for doing so.
4. Health and medical disclaimer
The Services are for general wellness and informational purposes only. They are not medical advice, and they are not intended to diagnose, treat, cure, monitor or prevent any disease or condition. The Services are not a medical device, and nothing in them creates a doctor–patient or other professional relationship. DayDay does not provide medical, nutritional, dietary or psychological advice.
- Talk to a doctor first. Consult a physician or other qualified health professional before starting any diet, weight-loss, exercise or sleep program, before making significant changes to what you eat, and if you have questions about your health.
- Don’t use the Services without your doctor’s approval if you are pregnant or breastfeeding, have or have had an eating disorder, have diabetes, heart, kidney or liver disease or any other medical condition, take medication that affects appetite, weight or sleep, or are underweight.
- Eating disorders. The Services are not designed for people with, or at risk of, an eating disorder. If tracking food, calories or weight makes you feel anxious or leads to unhealthy behavior, stop using the Services and seek help from a qualified professional.
- Sleep. Rest is not a sleep-disorder test. It cannot detect conditions such as sleep apnea or insomnia. If you are concerned about your sleep, see a doctor.
- Listen to your body. Stop and seek medical advice if you feel unwell, dizzy, faint or have any other symptom while following a plan.
- Emergencies. The Services are not for emergencies. If you think you may have a medical emergency, call your local emergency number immediately.
Never disregard professional medical advice or delay seeking it because of something you saw in the Services. You use the Services and act on any information in them at your own risk.
5. Estimates and results
Every number the Services show is an estimate, including calories eaten, calories burned, your daily target or deficit, what you have left to eat, weight trends, projected goal dates and sleep times. Estimates rely on information you enter, food reference data, your device and sensors, and third-party sources such as Apple Health, any of which may be incomplete or wrong. Calories burned in particular can vary widely from the estimate.
We do not guarantee that any estimate is accurate, complete or suitable for you, and we do not guarantee any result, including any amount or rate of weight loss or any improvement in sleep. Individual results vary. Example numbers on the Site are illustrations, not typical results.
6. Your responsibilities
- You are solely responsible for the decisions you make about your diet, exercise, sleep and health, and for checking that a goal or pace is safe for you.
- You are responsible for the accuracy of the information you enter and the permissions you grant.
- You are responsible for the security of your device, including its passcode and backups.
- You agree to use the Services only for your own personal, non-commercial use and in compliance with all applicable laws.
7. Your data and backups
You own the content you enter in the Apps. It is stored on your device, as described in our Privacy Policy, and we do not hold a copy. We are not responsible for any loss of your data, including loss caused by deleting the App, changing or losing your device, operating-system updates, software errors or failed backups. Use the export feature and your device’s backup options to keep your own copies.
8. Third-party services
The Services work with services we don’t control, such as Apple Health, the App Store, your device’s operating system, and our hosting provider. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, their availability, their data, or any changes they make, and we may stop supporting any of them at any time. Links to other websites are provided for convenience only.
9. Apple App Store terms
If you download an App from the Apple App Store, you also agree that:
- These Terms are between you and DayDay only, not Apple Inc. (“Apple”). DayDay, not Apple, is solely responsible for the App and its content.
- Your license to use the App is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Apple is not responsible for the investigation, defense, settlement or discharge of any third-party claim that the App or your use of it infringes that third party’s intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Fees
The Services are currently free. If we introduce paid features or subscriptions, the price and terms will be shown before you buy, and purchases through the App Store are processed by Apple under Apple’s terms, including its refund policies.
11. License and restrictions
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Apps on devices you own or control. You may not: copy, modify, distribute, sell or rent the Services; reverse engineer, decompile or try to extract their source code, except where the law expressly allows it; remove any proprietary notices; use the Services to build a competing product; scrape or harvest content; interfere with or disrupt the Services or their security; or use the Services for any unlawful purpose.
12. Our content and trademarks
The Services, including their software, text, illustrations, characters, icons, logos and design, are owned by DayDay or its licensors and are protected by intellectual property laws. “DayDay”, “Forward”, “Rest” and related logos are our trademarks. These Terms don’t give you any right to use them. The handwritten font Kalam is used under the SIL Open Font License. Apple, Apple Health, Apple Watch, iPhone and App Store are trademarks of Apple Inc.
13. Feedback
If you send us ideas or suggestions, you agree that we may use them without restriction or compensation to you.
14. Disclaimer of warranties
To the fullest extent permitted by law, the Services and all information in them are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment. We do not warrant that the Services will be uninterrupted, timely, secure or error-free, that any estimate or information will be accurate or reliable, that defects will be corrected, or that the Services will meet your requirements or help you achieve any result.
15. Limitation of liability
To the fullest extent permitted by law, in no event will DayDay, its owners, employees, contractors or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or health outcomes, arising out of or relating to the Services or these Terms, including any decision you make or action you take based on the Services, whether based on contract, tort (including negligence), statute or any other legal theory, even if we have been advised of the possibility of such damages.
Our total liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid us for the Services in the 12 months before the claim arose, or (b) fifty U.S. dollars (US$50).
Some jurisdictions don’t allow the exclusion of certain warranties or the limitation of certain damages. In those places, the exclusions and limits above apply only to the extent the law allows. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless DayDay and its owners, employees and contractors from any claims, losses, liabilities, damages and expenses (including reasonable legal fees) arising out of your use or misuse of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.
17. Suspension and termination
You may stop using the Services at any time by deleting the Apps. We may suspend or end your access to the Services at any time if we reasonably believe you have violated these Terms, or if we discontinue the Services. Sections 4–8 and 12–20 survive termination.
18. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which DayDay is established, without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. If you are a consumer, you keep the protection of any mandatory laws of the country where you live, and you may bring a claim in the courts of that country where the law allows.
19. Changes to these terms
We may update these Terms from time to time. We will post the new version here and update the date at the top; for material changes we will give reasonable notice in the App or on the Site. If you keep using the Services after the changes take effect, you accept the updated Terms. If you don’t agree, stop using the Services.
20. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a merger, acquisition or sale of assets. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived by contract.
